Public comment is limited to 2 minutes per speaker, unless adjusted by the presiding officer of the Board.

Motion for the Board to approve the Office of the City Clerk, Woodland Hills-Warner Center Neighborhood Council, Funding Program Fiscal Year Administrative Packet (Budget Packet) for fiscal year 2019/2020, July 2019 thru June 2020.

(19-164) Community Impact Statement – Council File No. 19-0002-S66
City Council Resolution concerning Substance Abuse and Alcohol Rehabilitation Facilities in the City of Los
Angeles
Discussion and possible action:
Motion from the WHWCNC WHIP Committee for the board to approve the following community impact statement
which supports City Council Resolution, Council File No. 19-0002-S66, concerning substance abuse and alcohol
addiction rehabilitation facilities in the City of Los Angeles:
MOTION:
WHEREAS Council Members Bob Blumenfield and Monica Rodriguez have created a LA City Resolution that addresses the problems created by both licensed and unlicensed drug and alcohol addiction rehabilitation facilities; and
WHEREAS the Resolution encompasses facilities such as sober living homes, community care facilities, group homes and other drug and alcohol addiction rehabilitation facilities; and
WHEREAS there are serious concerns about the quality of care provided to each patient residing in licensed and unlicensed drug and alcohol rehabilitation facilities in the City of LA and throughout the State of California; and
WHEREAS there are major concerns about the qualifications of the operators and staffs of these facilities, and concerns about the negative impacts these facilities can have on neighborhoods when not properly managed; and
WHEREAS a variety of State and Federal laws restrict the ability of the City of LA to guarantee the quality of care for patients; and
WHEREAS the Resolution supports the State’s approval and adoption of AB-1779, AB-1796 , and AB-447 that will require greater oversight of these facilities and allow Cities to regulate the size, density and locations of these facilities; and
WHEREAS Council Members Blumenfield and Rodriguez have further augmented this Resolution by:
– Requiring Building and Safety and the LAPD to report on the number of call for services related to these facilities; and,
– Requesting that Building and Safety coordinate with Planning on all zoning and building codes; and,
– Requesting that the LA Fire Department coordinate on any questions regarding occupancy violations; and,
– Requesting that the City investigate recommendations on issues related to administrative uses by these facilities that are not directly related to patient care and are being carried out within residential zones; and,
– Request that the City return a report back to the City Council within 90 days.
WHEREAS, the Woodland Hills – Warner Center Neighborhood Council [WHWCNC] substantially accepts the recommendations in the Blumenfield/Rodriguez Resolution; and,
WHEREAS, the WHWCNC Board agrees that greater oversight and control of these alcohol and drug rehabilitation facilities is necessary as quickly as possible;
THEREFORE, the Woodland Hills Impacts and Policies Committee recommends that the Board of the WHWCNC resolve to notify the City Council and the Mayor’s Office of its support of the City Resolution under Council File No. 19-0002-S66, and asks that the City Council and Mayor also consider the following additional measures:
1. Creating the use of “Special Permits” for establishing and operating an alcohol or substance abuse rehabilitation facility within LA City Limits.
2. Have the LA City Attorney investigate the measures that the City of Costa Mesa has taken in their successful lawsuit against problem rehabilitation cases, specifically as related to the Yellowstone Case Decision that allowed the city to impose restrictions and new regulations
3. Support Assembly Bill AB-920 in this Resolution regarding alcohol and drug abuse programs.
4. Instruct the City Attorney to investigate the potential of enforcing Nuisance Laws in respect to governing substance treatment homes.
5. Encourage insurance companies to adopt a policy of conducting regular inspections on the rehabilitation homes they are financially supporting through their patients and policy holders, and encourage them to self-regulate in instances where they find deficiencies.
6. Instruct City Department officials to analyze if the patients in the alcohol and substance abuse rehabilitation home are being allowed to integrate with the community (as required), or if they are being held inside the facility with no community interaction.
7. Investigate requiring Conditional Use Permits that can be investigated by the LA Police Department and/or other qualified City Departments.
Item No. (10) PLUM Committee – Lauren Coffman, Chair
(19-165) ZA-2019-1844-CUB – Sale of beer and wine at a gas station
20910 W. Vanowen Street, Woodland Hills, 91303
Discussion and possible action:
MOTION: As pertaining to Case ZA-2019-1844-CUB, having held one public meeting for the Application filed for a new conditional use permit to allow the sale and dispensing of beer and wine beverages (ABC Type 20 liquor license) for off‐site consumption in conjunction with an existing 854 square foot Gas Station Mini Mart. The existing establishment operates 24 hours daily and is located in the (WC) NORTH VILLAGE-SN-RIO Zone. The Mini Mart is proposing to sell alcoholic beverages between the hours of 8:00 am and midnight daily.
The Planning, Land Use and Mobility Committee hereby finds that:
WHEREAS, there is an 18 year precedence that no new CUB ‘s have been approved for gas stations in Woodland Hills; and
WHEREAS, alcohol should not be sold where people are obtaining gasoline and driving; and
WHEREAS, there is a major liquor store across the street from this establishment where patrons can purchase liquor; and
WHEREAS, approving a CUB will lead to a virtual land rush of previously unapproved CUB requests and new CUB requests from gas stations, which will overall negatively affect the community; and
WHEREAS, the recommended action is made without prejudice for the applicant but based on an existing 18 year precedence policy;
THEREFORE, IT IS HEREBY RESOLVED that the Planning, Land Use and Mobility Committee, for the findings and conditions stated herein, finds that the submitted application and plans for the proposed Conditional Use Permit at the Gas Station Mini Mart, located at 20910 Vanowen St, Los Angeles, CA 91303 should not receive the support of the Board of the Woodland Hills-Warner Center Neighborhood Council :
The Planning, Land Use and Mobility Committee recommends that the Board of the Woodland Hills-Warner Center Neighborhood Council advise the City of Los Angeles Planning Department and Council District 3 Councilmember Bob Blumenfield of its findings, and its subsequent supporting recommendation to not approve this application as presented on June 20, 2019.
