(Only the Mayor and the City Council have power over intergovernmental relations\, which include advocating the City’s position on laws that are pending with state or federal agencies or before the state legislature or federal government.)\,” and\n• “Neighborhood Councils may not advocate their positions to non-Coty [sic] governmental agencies because Neighborhood Councils\, pursuant to the Charter\, are advisory to the City’s decision-makers.”\nAs a replacement memorandum\, we ask that the City Attorney advise Neighborhood Councils with the following guidance:\n• “Neighborhood Councils may advocate community positions to Non-City governmental agencies because these agencies shape policy\, and procedures\, and implement actions that affect the stakeholders whom Neighborhood Councils represent.”\n• “Neighborhood Councils may\, in an appropriate manner\, advocate community positions on local\, state and federal legislation to the local\, state or federal legislators who represent the district in which the Neighborhood Council exists.”\n• “Neighborhood Councils must clearly state that the requests and opinions stated in their communication do not necessarily represent the official position of the City of Los Angeles and solely represent the position of the Neighborhood Council.”\n• “Neighborhood Councils must submit to the City Clerk a copy of any written communication seeking/lobbying for actions sent to any government agency which is not part of the City of Los Angeles.”\nWe need to point out to you that throughout the months of December\, January\, and February\, staffers from our respective Senate and Assembly Districts have attended Neighborhood Council Board meetings. Representatives urged Boards to send any legislative requests to their State Senators and Assembly Members so that they can be considered for addition to their 2020 Legislative Agendas.\nCurrent City Attorney guidance currently prohibits Neighborhood Councils from taking any such action.\nAccording to the guidance offered\, Neighborhood Councils have only two options to voice their opinion on proposed legislation. The first is to ask our City Councilperson to advocate for legislation that currently does not exist\, and which he/she will have no responsibility nor ability to create at the state level. The second option is to ask our City Councilperson to forward a letter to state Legislator(s)\, rendering he/she little more than an intermediary messenger.\nThis limitation is impractical and appears to be an attempt to cripple Neighborhood Councils’ ability to advocate causes directly to their elected representatives.\nConsider the following scenarios that demonstrate why current policy does not work:\n1. When a City Councilperson resigns from office\, leaving their seat vacant.\nIf the Neighborhood Council has no current Councilperson\, and the current policy bars them from directly advocating to their local\, county\, state\, or federal legislator\, then how do they advocate on local\, county\, state or federal legislative issues\, or government agency interpretations? The policy leaves communities represented by their Neighborhood Councils without a voice on pressing matters through no fault of their own. Additionally\, proper guidance would not force a Neighborhood Council to work through another Council District\, for which they do not have a relationship established (assuming another councilperson could be persuaded and had the capacity to do so).\nA vacant City Council seat should not mute Neighborhood Councils.\n2. When a City Councilperson disagrees with a Neighborhood Council’s advocacy position and fails/refuses to act as a conduit.\nIf a City Councilperson decides\, that it is personally or politically expedient for him/her to ignore the advocacy of a Neighborhood Council\, and then refuses to pass on any concerns or advocate an issue to the local\, state or federal legislators representing a Neighborhood Council\, they effectively suppress the Council’s voice. The Neighborhood Council’s ability to advocate on behalf of its stakeholders is nonexistent. Once again\, proper guidance should not force a Neighborhood Council to work through another Council District\, for which they do not have a relationship established. What are the odds of finding a Councilperson willing to go against one of their own?\nNo City Councilperson should have this much control over the voice of the collection of constituents elected to Neighborhood Councils to represent their local communities. One improvement under guidelines would be to allow Neighborhood Council to create Council Files asking for City Council action.\n3. When a City Councilperson is unable to initiate actions on behalf of Neighborhood Councils results in critical deadlines missed.\nIt’s quite likely that a busy City Councilperson will not see or have time to address referring Neighborhood Council communications far enough in advance of critical Public Comment deadlines. Then Neighborhood Councils have lost their ability to voice their concerns or support for policy or critical legislative issues that affect their stakeholders. Moreover\, the cause of this could be nothing more than a matter of the limited District staff resources or inefficient bureaucratic city protocol. These limitations are easily avoidable when Neighborhood Councils can advocate directly to the local\, state\, and federal legislators or agency staff responsible for the matters considered. Why should\nNeighborhood Councils\, who make efforts to meet deadlines on impacting local\, state\, and federal policy or legislative issues\, be hindered by their City Councilperson from meeting commentary deadlines?\nRequiring Neighborhood Councils to rely on the prompt actions of Councilpersons should not artificially constrain their ability to address pressing policy or legislative matters.\n4. When\, assuming a City Council Member does initiate City action\, limited resources\, along with competing priorities of the City\, result in either slow or no City action\, or the delayed actions result in no advice rendered before deadlines arrive.\nIf the City Council is unable to lobby or misses critical deadlines for Public Comment due to its inability to act or the inability of Departments to respond in time\, then the consequence is that Neighborhood Councils lose their ability to voice their concerns or support for a critical policy or legislative issues that affect their stakeholders. The City and its inhabitants suffer when it fails to timely weigh in. The contributions of Neighborhood Councils fill the gap.\nStifling Neighborhood Councils from addressing important community issues by requiring them to rely on the prompt actions of the City Council or City Departments is obstructive. Current guidance is contrary to the Charter’s intentions.\nWe believe it is our duty to our stakeholders to be able to advocate on their behalf to the local\, county\, state\, and federal legislators and regulatory agencies\, who are directly responsible for enacting legislative agendas and regulatory guidelines promptly.\nForcing Neighborhood Councils to address matters\, which are solely the responsibility of local\, state\, or federal legislators\, through the City Council\, constrains Neighborhood Councils and results in unnecessary bureaucratic delay. It forces Neighborhood Councils to address their concerns to a level of government that has no jurisdiction or control over impending local\, state\, or federal legislative issues. It opens the opportunity to ignore those matters for purely political or bureaucratic reasons. These situations are anathema to the very system of Neighborhood Councils representing their communities at the grass roots level.\nNowhere in Article IX of the City Charter does it explicitly prohibit Neighborhood Councils from directly contacting local\, county\, state\, and federal legislators who represent them or non-city government agencies who have impacts on our local communities.\nCharter Article IX\, Section 900\, which expressly lays out the Purpose of the Department of Neighborhood Empowerment\, and the creation of the Neighborhood Council system\, states:\n“To promote more citizen participation in government and make government more responsive to local needs\, a citywide system of neighborhood councils and a Department of Neighborhood Empowerment is created. Neighborhood Councils shall include representatives of the many diverse interests in communities and shall have an advisory role on issues of concern to the neighborhood.”\nWe point out that it says “government” implying all levels\, not just the City.\nSimilarly\, contrary to what we are told\, nowhere in the Charter are Neighborhood Councils restricted to communications solely with the City Council and its members. The staffing levels are anticipated to expand to 50 rangers by mid-2020. Every day\,\npark rangers patrol the City’s parks day and night\, often in remote and desolate areas of the City\, and assist other City law enforcement agencies\, including the Los Angeles Police Department (LAPD). Approximately 70 percent of a ranger’s daily duties are related to law enforcement activities and the first responder to an emergency in a City park is likely to be a park ranger.\nEvery sworn park ranger assigned to RAP’s Park Ranger Division is required to complete a six-month Certified Academy Training Course\, which includes\, among other things\, firearm training. The course is administered by California Police Officer Standard and Training (CAPOST)\, which regulates standards and training for all California law enforcement agencies throughout the state. CAPOST recognizes the City of Los Angeles Park Ranger Division and its sworn personnel as a law enforcement agency with full police powers to detain\, arrest\, book criminal violators\, conduct investigations into criminal activity\, and beyond. RAP park rangers are also considered full law enforcement officers under California Penal Code (CPC) section 830.1 and have full police powers throughout the State of California.\nFor the protection of the public and for the safety of all law enforcement officers in the City\, it is necessary to amend LAMC section 63.41\, to allow park rangers to be armed while on duty\, as authorized by CPC §830.31 (b) which states\, “ a person designated by a local agency as a park ranger\, who is regularly employed and paid in that capacity\, and whose primary duty is the protection of parks\, may be armed by their employing agency.”\nPark rangers should have the full ability to utilize all law enforcement tools and equipment to ensure the safety and security of the public under all circumstances.\nI THEREFORE MOVE that the City Attorney be DIRECTED to prepare and present an ordinance amending LAMC Section 63.41 to allow park rangers to be armed while on duty\, in accordance with state law.\nI FURTHER MOVE that the Department of Recreation and Parks be DIRECTED to report back on the department’s plans for Use of Force policies; tactics and training; partnership\, if any\, with the Los Angeles Police Department on Categorical Uses of Force Investigations; counseling and psychological evaluations following a Categorical Use of Force incidents; and the budgetary impacts of the proposed program to arm park rangers.\nI FURTHER MOVE that the Department of Recreation and Parks and the Los Angeles Police Department be DIRECTED to report back with policies and procedures for the implementation of the proposed program to arm\npark rangers. Ventura Blvd\, Woodland Hills\, CA 91364\, receive the support of the Board of the Woodland Hills-Warner Center Neighborhood Council for the requested actions contingent upon the following conditions:\nConditions\n1. All personnel acting in the capacity of manager or server at the premise shall attend a Standardized Training for Alcohol Retailers (STAR) session sponsored by the Los Angeles Police Department (LAPD).\n2. The Petitioner(s) shall be responsible for maintaining free of litter\, the area\, and adjacent to the premises over which they have control.\n3. No alcoholic beverage shall be consumed on any property adjacent to the licensed premises under the control of the licensees.\n4. No intoxicated person or persons observed publicly drinking shall be admitted to the location\,\n5. The parking spaces allotted to the applicant on the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot.\n6. No illuminated (i.e.\, neon) or alcohol advertising or digital signage of any type will be located in the windows or on the business storefront.\n7. Signs shall be posted in English\, and the predominant language of the facility’s clientele\, if different\, that California State Law prohibits the sale of alcoholic beverages to persons who are under 21 years of age.\n8. The applicant shall provide the Zoning Administrator a copy of each license suspension thereof or citation issued by the Los Angeles Police Department or State Department of Alcoholic Beverage Control upon such issuance.\n9. No smoking of tobacco or recreational/medical marijuana products\, including cigarettes\, cigars\, hookah\, vape or water pipes either inside the location or on any outdoor patios.\n10. That all exterior public space (front\, side\, and rear) will be illuminated with sufficient lighting for the police to identify all persons standing outdoors at night.\n11. The business operator shall install video surveillance cameras and monitors inside the premises and cameras outside\, which show the outside frontage area\, to the satisfaction of the Police Department prior to the exercise of the grant. Evidence of compliance shall be submitted by the business operator to the Zoning Administrator. The business operator shall maintain the video for at least two weeks and have them made available to the Police Department upon request.\n12. That the authorized use shall be conducted at all times with due regard for the character of the surrounding district\, and the right is reserved by the Zoning Administrator to impose additional corrective conditions\, if\, in the Administrator’s opinion\, such conditions are proven necessary for the protections of persons in the neighborhood or occupants of adjacent property or to revoke or amend this authorization if conditions are not met\, or operation of the site continues to constitute a nuisance.\n13. At all times when the premises are open for business\, the sale of alcoholic beverages shall be incidental to the sale of food.\n14. There shall be no live entertainment\, amplified music\, or dancing permitted on the premises at any time.\n15. These Conditions of Approval shall be retained on the property at all times and shall be produced immediately upon the request of a Police Officer. The manager shall be made aware of the Conditions and inform their employees of the same. The manager shall also maintain an emergency contact number for the property owner.\n16. (Only the Mayor and the City Council have power over intergovernmental relations\, which include advocating the City’s position on laws that are pending with state or federal agencies or before the state legislature or federal government.)\,” and\n• “Neighborhood Councils may not advocate their positions to non-Coty [sic] governmental agencies because Neighborhood Councils\, pursuant to the Charter\, are advisory to the City’s decision-makers.”\nAs a replacement memorandum\, we ask that the City Attorney advise Neighborhood Councils with the following guidance:\n• “Neighborhood Councils may advocate community positions to Non-City governmental agencies because these agencies shape policy\, and procedures\, and implement actions that affect the stakeholders whom Neighborhood Councils represent.”\n• “Neighborhood Councils may\, in an appropriate manner\, advocate community positions on local\, state and federal legislation to the local\, state or federal legislators who represent the district in which the Neighborhood Council exists.”\n• “Neighborhood Councils must clearly state that the requests and opinions stated in their communication do not necessarily represent the official position of the City of Los Angeles and solely represent the position of the Neighborhood Council.”\n• “Neighborhood Councils must submit to the City Clerk a copy of any written communication seeking/lobbying for actions sent to any government agency which is not part of the City of Los Angeles.”\nWe need to point out to you that throughout the months of December\, January\, and February\, staffers from our respective Senate and Assembly Districts have attended Neighborhood Council Board meetings. Representatives urged Boards to send any legislative requests to their State Senators and Assembly Members so that they can be considered for addition to their 2020 Legislative Agendas.\nCurrent City Attorney guidance currently prohibits Neighborhood Councils from taking any such action.\nAccording to the guidance offered\, Neighborhood Councils have only two options to voice their opinion on proposed legislation. The first is to ask our City Councilperson to advocate for legislation that currently does not exist\, and which he/she will have no responsibility nor ability to create at the state level. The second option is to ask our City Councilperson to forward a letter to state Legislator(s)\, rendering he/she little more than an intermediary messenger.\nThis limitation is impractical and appears to be an attempt to cripple Neighborhood Councils’ ability to advocate causes directly to their elected representatives.\nConsider the following scenarios that demonstrate why current policy does not work:\n1. When a City Councilperson resigns from office\, leaving their seat vacant.\nIf the Neighborhood Council has no current Councilperson\, and the current policy bars them from directly advocating to their local\, county\, state\, or federal legislator\, then how do they advocate on local\, county\, state or federal legislative issues\, or government agency interpretations? The policy leaves communities represented by their Neighborhood Councils without a voice on pressing matters through no fault of their own. Additionally\, proper guidance would not force a Neighborhood Council to work through another Council District\, for which they do not have a relationship established (assuming another councilperson could be persuaded and had the capacity to do so).\nA vacant City Council seat should not mute Neighborhood Councils.\n2. When a City Councilperson disagrees with a Neighborhood Council’s advocacy position and fails/refuses to act as a conduit.\nIf a City Councilperson decides\, that it is personally or politically expedient for him/her to ignore the advocacy of a Neighborhood Council\, and then refuses to pass on any concerns or advocate an issue to the local\, state or federal legislators representing a Neighborhood Council\, they effectively suppress the Council’s voice. The Neighborhood Council’s ability to advocate on behalf of its stakeholders is nonexistent. Once again\, proper guidance should not force a Neighborhood Council to work through another Council District\, for which they do not have a relationship established. What are the odds of finding a Councilperson willing to go against one of their own?\nNo City Councilperson should have this much control over the voice of the collection of constituents elected to Neighborhood Councils to represent their local communities. One improvement under guidelines would be to allow Neighborhood Council to create Council Files asking for City Council action.\n3. When a City Councilperson is unable to initiate actions on behalf of Neighborhood Councils results in critical deadlines missed.\nIt’s quite likely that a busy City Councilperson will not see or have time to address referring Neighborhood Council communications far enough in advance of critical Public Comment deadlines. Then Neighborhood Councils have lost their ability to voice their concerns or support for policy or critical legislative issues that affect their stakeholders. Moreover\, the cause of this could be nothing more than a matter of the limited District staff resources or inefficient bureaucratic city protocol. These limitations are easily avoidable when Neighborhood Councils can advocate directly to the local\, state\, and federal legislators or agency staff responsible for the matters considered. Why should Neighborhood Councils\, who make efforts to meet deadlines on impacting local\, state\, and federal policy or legislative issues\, be hindered by their City Councilperson from meeting commentary deadlines?\nRequiring Neighborhood Councils to rely on the prompt actions of Councilpersons should not artificially constrain their ability to address pressing policy or legislative matters.\n4. When\, assuming a City Council Member does initiate City action\, limited resources\, along with competing priorities of the City\, result in either slow or no City action\, or the delayed actions result in no advice rendered before deadlines arrive.\nIf the City Council is unable to lobby or misses critical deadlines for Public Comment due to its inability to act or the inability of Departments to respond in time\, then the consequence is that Neighborhood Councils lose their ability to voice their concerns or support for a critical policy or legislative issues that affect their stakeholders. The City and its inhabitants suffer when it fails to timely weigh in. The contributions of Neighborhood Councils fill the gap.\nStifling Neighborhood Councils from addressing important community issues by requiring them to rely on the prompt actions of the City Council or City Departments is obstructive. Current guidance is contrary to the Charter’s intentions.\nWe believe it is our duty to our stakeholders to be able to advocate on their behalf to the local\, county\, state\, and federal legislators and regulatory agencies\, who are directly responsible for enacting legislative agendas and regulatory guidelines promptly.\nForcing Neighborhood Councils to address matters\, which are solely the responsibility of local\, state\, or federal legislators\, through the City Council\, constrains Neighborhood Councils and results in unnecessary bureaucratic delay. It forces Neighborhood Councils to address their concerns to a level of government that has no jurisdiction or control over impending local\, state\, or federal legislative issues. It opens the opportunity to ignore those matters for purely political or bureaucratic reasons. These situations are anathema to the very system of Neighborhood Councils representing their communities at the grass roots level.\nNowhere in Article IX of the City Charter does it explicitly prohibit Neighborhood Councils from directly contacting local\, county\, state\, and federal legislators who represent them or non-city government agencies who have impacts on our local communities.\nCharter Article IX\, Section 900\, which expressly lays out the Purpose of the Department of Neighborhood Empowerment\, and the creation of the Neighborhood Council system\, states:\n“To promote more citizen participation in government and make government more responsive to local needs\, a citywide system of neighborhood councils and a Department of Neighborhood Empowerment is created. Neighborhood Councils shall include representatives of the many diverse interests in communities and shall have an advisory role on issues of concern to the neighborhood.”\nWe point out that it says “government” implying all levels\, not just the City.\nSimilarly\, contrary to what we are told\, nowhere in the Charter are Neighborhood Councils restricted to communications solely with the City Council and its members. The location is within an apartment complex known as The Boulevard. \nANALYSIS: \nExisting Site Conditions:  The application is for a single location within a 190\,691 sq ft apartment house. The proposed restaurant where the conditional use will apply is a ground floor\, 4\,051 sq ft. location with a total occupancy of 135\, according to the Los Angeles Fire Department. The seating includes 101 indoors and 34 outdoors where alcohol sales are proposed. All sales and restaurant facilities are entirely located on private property. The location provides 50 shared parking spaces. There is no plan to expand the floor space. There is offsite parking on Ventura Blvd. The site is not within 1\,000 feet of a Church or School.  There will be no entertainment component\, dancing\, music\, or any other adult entertainment. There are no LAPD complaints associated with the site.  Food will be sold on-site\, and alcohol will be sold only with a food purchase. There will be no alcohol sales for offsite consumption. There will be no sales of commemorative mugs or glasses. Alcohol sold in cans or bottles will not exceed 750 ml. The facility complies with the Caldera Bill\, Secs. 23958 and 23958.4 as the establishment is a restaurant. \nRESOLUTION \nAs pertaining to Case ZA-2020-0032-CUB\, having held one public PLUM meeting March 5th\, 2020 and a full board meeting on June 10\, 2020 to review an application for a Conditional Use Permit\, pursuant to the provisions of section 12.23-W.1 of the Los Angeles Municipal Code\, to allow the sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with an existing 4\,051 sq. ft. location with total occupancy 135 and includes 101 indoors and 34 outdoors where alcohol sales are proposed\, having the hours of operation from 7 AM to 11 PM daily within the Ventura Boulevard Specific Plan area.: \n  \nWHEREAS\, The applicant request authorization of a CUB to allow for the sale and serving a full line of alcohol; and\, \nWHEREAS\, the applicant’s proposed location for alcohol service is located entirely on private property and has exclusive control over premises where alcohol is served\, \nTHEREFORE\, the Planning\, Land Use\, and Mobility Committee\, for the findings and conditions stated herein\, finds that the submitted application and plans by Michael Mach/Urban Society Restaurant\, for the proposed Conditional Use Permit at “The Boulevard” located at 20600 W. Ventura Blvd\, Woodland Hills\, CA 91364\, receive the support of the Board of the Woodland Hills-Warner Center Neighborhood Council for the requested actions contingent upon the following conditions: \nCONDITIONS: \n\nAll personnel acting in the capacity of manager or server at the premise shall attend a Standardized Training for Alcohol Retailers (STAR) session sponsored by the Los Angeles Police Department (LAPD).\nThe Petitioner(s) shall be responsible for maintaining free of litter\, the area\, and adjacent to the premises over which they have control.\nNo alcoholic beverage shall be consumed on any property adjacent to the licensed premises under the control of the licensees.\nNo intoxicated person or persons observed publicly drinking shall be admitted to the location\,\nThe parking spaces allotted to the applicant on the premises shall be equipped with lighting of sufficient power to illuminate and make easily discernible the appearance and conduct of all persons on or about the parking lot.\nNo illuminated (i.e.\, neon) or alcohol advertising or digital signage of any type will be located in the windows or on the business storefront.\nSigns shall be posted in English\, and the predominant language of the facility’s clientele\, if different\, that California State Law prohibits the sale of alcoholic beverages to persons who are under 21 years of age.\nThe applicant shall provide the Zoning Administrator a copy of each license suspension thereof or citation issued by the Los Angeles Police Department or State Department of Alcoholic Beverage Control upon such issuance.\nNo smoking of tobacco or recreational/medical marijuana products\, including cigarettes\, cigars\, hookah\, vape\, or water pipes either inside the location or on any outdoor patios.\nThat all exterior public space (front\, side\, and rear) will be illuminated with sufficient lighting for the police to identify all persons standing outdoors at night.\nThe business operator shall install video surveillance cameras and monitors inside the premises and cameras outside\, which show the outside frontage area\, to the satisfaction of the Police Department prior to the exercise of the grant. Evidence of compliance shall be submitted by the business operator to the Zoning Administrator. The business operator shall maintain the video for at least two weeks and have them made available to the Police Department upon request.\nThat the authorized use shall be conducted at all times with due regard for the character of the surrounding district\, and the right is reserved by the Zoning Administrator to impose additional corrective conditions\, if\, in the Administrator’s opinion\, such conditions are proven necessary for the protection of persons in the neighborhood or occupants of adjacent property or to revoke or amend this authorization if conditions are not met\, or operation of the site continues to constitute a nuisance.\nAt all times when the premises are open for business\, the sale of alcoholic beverages shall be incidental to the sale of food.\nThere shall be no live entertainment\, amplified music\, or dancing permitted on the premises at any time.\nThese Conditions of Approval shall be retained on the property at all times and shall be produced immediately upon the request of a Police Officer. The manager shall be made aware of the Conditions and inform their employees of the same. There are no walls or partitions separating seating areas; and\,\nThe property does not abut an A or R zone nor an A or R zone across the alley; and\,\nOutdoor food and beverage service shall be limited to seated patrons; and\,\nThere shall be no live entertainment\, karaoke\, or disc jockeys on the premises; and\,\nThere shall be no television monitors or screens\, in any outdoor area; and\,\nEntertainment in conjunction with the restaurant is limited to ambient music to complement the dining experience\, and is limited to background music at a low volume that is not audible beyond 20 feet from the building; and\,\nAny music\, sound or noise under control of the restaurant will not violate Sections 112.06 or 116.01 of the Los Angeles Municipal Code (citywide noise regulations).\nAny use of the restaurant for private events\, including corporate events\, birthday parties\, anniversary parties\, weddings or other private events which are not open to the general public\, shall be subject to all the same provisions and hours of operation stated herein; and\,\nA telephone number and an email address shall be provided for complaints or concerns regarding the operation of the restaurant. The phone number and email address shall be posted on a sign at least 8.5 × 11 inches in size\, which shall be updated to reflect any changes\, at the entry visible to pedestrians and in the reception area; and\,\nComplaints shall be responded to within 24 hours by the restaurant. The restaurant shall maintain a log of all calls and emails\, detailing the date the complaint was received\, the nature of the complaint\, and the manner in which the complaint was resolved. This log shall be made available to the Department of City Planning upon request. Within the restaurant\, the interior shall be adequately illuminated so as to make discernible all objects and persons\, or have a minimum average surface illumination of 2.0 foot candles (21.5 lx); and\,\nAll exterior portions of the site shall be adequately illuminated in the evening so as to make discernible the faces and clothing of persons utilizing the space\, or have a minimum average surface illumination of 0.2 foot candles (2.15 lx). Lighting shall be directed onto the site without being disruptive to persons on adjacent properties; and\,\nA camera surveillance system shall be installed and in operation at all times to monitor the interior\, entrance\, exits and exterior areas\, in front of and around the premises. Recordings shall be maintained for a minimum period of 30 days and are intended for use by the Los Angeles Police Department; and\,\nThe restaurant shall be responsible for maintaining the premises and adjoining rights-of- way free of debris and litter; and\,\nThe restaurant shall be responsible for monitoring both patron and employee conduct on the premises and within the parking areas under its control to prevent behavior that adversely affects or detracts from the quality of life for adjoining residents\, property owners\, and businesses.\nThe restaurant shall take all reasonable steps to ensure the conditions and activities on the premises and within the parking areas under its control do not adversely affect or detract from the quality of life for adjoining properties\, property owners\, and businesses; and\nWithin 24 hours of its occurrence\, all graffiti on the property under the restaurant’s control shall be removed or painted over to match the color of the surface to which it is applied; and\,\nAll trash and recycling bins under control of the restaurant shall be kept closed and locked at all times when they are not in use\, and shall be maintained such that they do not overflow; and\,\nLoitering is prohibited on all areas under the control of the restaurant. A “No Loitering or Public Drinking” sign that is a minimum of 4 × 6 inches shall be posted outside next to every exit; and\,\nAn electronic age verification device shall be retained on the premises available for use during operational hours. This device shall be maintained in operational condition and all employees shall be instructed in its use; and\,\nThe restaurant shall comply with California Labor Code 6404.5 which prohibits the smoking of tobacco or any non-tobacco substance\, including from electronic smoking devices or hookah pipes\, within any enclosed place of employment; and\,\nA minimum of one on-duty manager with authority over the activities within the restaurant shall be on the premises at all times that the restaurant is open for business. The on-duty manager’s responsibilities shall include the monitoring of the premises to ensure compliance with all applicable State laws\, Municipal Code requirements and the conditions imposed by the Department of Alcoholic Beverage Control (ABC). The restaurant shall be responsible for discouraging illegal and criminal activity on the subject premises and any exterior area under its control; and\,\nWithin the first six months of operation or the administrative clearance\, all employees involved with the sale of alcohol shall enroll in the Los Angeles Police Department “Standardized Training for Alcohol Retailers” (STAR) or Department of Alcoholic Beverage Control “Licensee Education on Alcohol and Drugs” (LEAD) training program or the Responsible Beverage Service (RBS) Training Program. Upon completion of such training\, the restaurant shall request the Police Department or Department of Alcohol Beverage Control to issue a letter identifying which employees completed the training. Said letter shall be maintained on the premises and shall be made available to the City upon request. STAR or LEAD or RBS training shall be conducted for all new hires within three months of their employment; and\,\nA Revocable Permit from the Bureau of Engineering\, Department of Public Works is required for any outdoor dining area located in the public right- of-way. A copy of the approved Revocable Permit\, including a plot plan and any conditions thereto\, shall be provided to the Department of City Planning prior to placing any seating in the public right-of-way; and\,\nThe owner or the operator will reapply under the Restaurant Beverage Program or a Conditional Use Permit if there is: (A) a change in State alcohol license type or (B) a modification to the floor plan\, including\, but not limited to\, floor area or number of seats or (C) a change in the ownership or the operator of the restaurant; and\,\nThe City shall have the authority to conduct inspections to verify compliance with any and all of these requirements; and\,\nA copy of the approval requirements from City Planning shall be retained on the premises at all times and produced upon request by the Police Department\, the Department of Building and Safety\, the Department of City Planning\, or the California Department of Alcoholic Beverage Control; and\,\nPrior to the Conditional Use Permit final approval\, the owner and operator shall execute and record a covenant and agreement satisfactory to the Director of Planning\, acknowledging that the owner and operator shall agree to comply with each of the provisions set forth in the determination letter. A certified copy bearing the Recorder’s number and date shall be provided to the Department of City Planning. The agreement shall run with the land and shall be binding on any subsequent owners\, heirs or assigns. The agreement with the requirements attached must be submitted to the Department of City Planning for approval before being recorded; and\,\n\nWHEREAS\, the above conditions mostly follow the proposed requirements for the proposed new Restaurant Beverage Program from City Planning; \nTHEREFORE\, IT IS HEREBY RESOLVED that the Planning\, Land Use and Mobility Committee\, for the statements and conditions stated herein\, recommends  that this PLUM Motion regarding the Conditional Use Permit application and plans submitted on behalf of Sandra Cordero \, for Gasolina LLC\, located at 21150 W. Ventura Blvd.\, Woodland Hills\, CA 91364\, be adopted as its own to receive the support of the Board of the Woodland Hills-Warner Center Neighborhood Council for the requested actions contingent upon the following conditions: \nConditions \n\nThe applicant reduces the outdoor seating to 20 seats; and\,\nThe Patio railing will be a fixed railing system to the satisfaction of Bureau of Engineering under a Revocable Permit.\n\nThe Planning\, Land Use and Mobility Committee recommend that the Board of the Woodland Hills-Warner Center Neighborhood Council advise the City of Los Angeles Planning Department and Council District 3 Councilmember Bob Blumenfield of its findings\, and its subsequent supporting recommendation to approve this application as presented on July 8th\, 2020.                                                                                                          ROLL CALL VOTE \nItem No. (6) PLUM Committee – Lauren Coffman\, Chair  \n(20-035) Case ZA-2018-7428-ELD-SPP-MCUP – Project proposal to construct a four building\, mixed use Continuing Care Retirement Community (Senior Housing with Eldercare) a medical healthcare center\, and a 34-level medical office tower on 17.62 acres of a 58.9 acre site \n5500 North Canoga Ave.\, Woodland Hills\, CA 91367 \n  \nDiscussion and possible action: \nAs pertains to Case ZA-2018-7428-ELD-SPP-MCUP\, having held 5 public meetings (including the Board meeting) (three virtually) for the application filed by Spieker Senior Development Partners regarding a development in the Commerce District of Warner Center under the Warner Center 2035 Specific Plan (WC2035)\, the Planning\, Land Use and Mobility Committee hereby finds that: \nMOTION : WHEREAS\, the Applicant has designed and seeks Project Permit Compliance for a submitted proposal to construct a four building\, mixed use Continuing Care Retirement Community (Senior Housing with Eldercare) project with approximately 2.2 million sq. ft. of floor area in four phases\, including 498 independent living dwelling units\, 13 hotel rooms\, 91 guest units providing memory care\, assisted living and skilled nursing care and amenities\, as well as restaurant/retail use\, a pool/fitness building for residents\, a medical healthcare center\, and a 34-level medical office tower on 17.62 acres of a 58.9 acre site at 5500 North Canoga Ave. that in the opinion of the committee\, now complies with the existing WC2035 standards and guidelines; and\, \nWHEREAS\, the project originally sought deviation from WC2035 Permitted Floor Area standards under Section 6.1.2.2.3 of WC 2035\, because of stated hardships\, through the Eldercare Facility Unified Permit Process; and\, \nWHEREAS\, the committee is concerned that future use of the Eldercare Facility Unified Permit Process to avoid development standards can substantially disrupt the future sustainability of Warner Center economy for stakeholders to live\, work and play in their urban community; and\, \nWHEREAS\, the project now has been revised to comply with the WC2035 Permitted Floor Area standards\, under Section 6.1.2.2.3 of WC 2035\, due to reduction of residential uses and significant increases of non-residential uses\, the Applicant no longer needs deviation from the standard through the Eldercare Facility Unified Permit Process and is withdrawing the Eldercare Application; and\, \nWHEREAS\, the Applicant has withdrawn a Master Conditional Use Permit for the onsite sale of beer and wine for 1 tenant and the onsite sale of a full line of alcoholic beverages for up to 8 tenants; and\, \nWHEREAS\, given recent events in Southern California\, the PLUM Committee has concerns regarding the need for appropriate measures to prevent retail looting and arson within a mixed-use environment serving seniors with varying degrees of mobility; and \nWHEREAS\, the project Applicant has acknowledged and accepted the conditions of the Neighborhood Council and agreed to include them on a project summary page in revised project plan submittal; \nTHEREFORE\, IT IS HEREBY RESOLVED that the Planning\, Land Use and Mobility Committee\, for the findings and conditions stated herein\, finds that the submitted application and plans for the proposed project at 5500 Canoga Avenue\, Woodland Hills\, 91367\, and recommends that the Board of the Woodland Hills-Warner Center Neighborhood Council adopt this motion of the committee as its own in SUPPORT of the remaining requested actions as stated contingent upon adoption by the Applicant of the following conditions: \nConditions:  \n1.) All plans presented on July 8\, 2020 at the virtual Board Meeting of the Woodland Hills – Warner Center Neighborhood Council (WHWCNC) shall be dated as such and re-submitted to Planning as an (updated) project application submittal. \n2.) The applicant will not submit any significant\, further updated plans without first presenting them to the WHWCNC for support. \n3.) Additionally\, all conditions herein shall be printed on one of the Project Summary pages as a commitment to and acceptance of these conditions. \n4.) Prior to the issuance of any building permits relative to the development on the Project Site\, a covenant acknowledging and agreeing to develop the Project Site in Substantial Conformance with the Project Plans\, as approved by the Department of City Planning and consistent with the requirements of the WC 2035 Plan shall be recorded in the County Recorder’s Office. The agreement (standard master covenant and agreement form CP-6770) shall run with the land and shall be binding on any subsequent owners\, heirs or assigns. \n5.) All current and future property owner(s) accept responsibility to provide unhindered block connectivity and Publicly Accessible Open Space\, and agree to make reasonable accommodations\, including any reasonable grade revision and any conversion of the private drive to new shared street requirements by adjacent projects to facilitate all future integration of unencumbered pedestrian adapted pathways and street access between the project and the adjacent property(ies). \n6.) Additional 10-12 feet of height (up to 95 feet total) of non-livable space shall be added to the 6-7 stories of the residential building along Canoga and Burbank to break up monotony of the façades. \n7.) Applicant will provide and manage reasonable and sufficient pet waste facilities for use by the public along parkways. \n8.) Applicant shall add landscape plan meeting the WC2035 requirements for the “temporary parking lot” to be replaced by Building #4. The temporary surface parking plan will be revised to allow for the provision of 1 tree per every 4 surface parking spaces \n9.) The “temporary parking lot” for Phase IV (The Tower) shall be permitted for a term of five (5) years after the Certificate of Occupancy for the Health Center (Phase III) of the project is issued. After 5 years\, the Director of Planning and/or the CD-3 has the discretion to extend the parking for no more than a second 5-year term. After 10 years\, if construction of Phase IV has not started\, the lot space shall be converted to planted\, green PAOS until Phase IV begins construction. \n10.) Applicant will provide pedestrian friendly gating and/or screening to attractively hide any loading facility along private streets and drives. \n11.) Applicant will provide –to the satisfaction of Police and Fire Departments– measures to prevent retail looting and arson to protect elderly residents. \n12.) Ten (10) additional short-term bike or scooter parking spaces will be relocated adjacent to the park within the PAOS Plaza on Canoga for a total of twenty (20). More short-term bike parking will be provided should there be demand and/or requested by the Council District office. \n13.)
